It took the IRS 16 months to respond to our letter requesting to waive a small penalty that shouldn't have been assessed. Things must be going pretty great over there.
Can someone in #taxtwitter sell me a great office chair? Bonus points if it comes in orange, but something comfy for home office working. My elbows must be pointing as heck because I always destroy the little armrests on chairs quickly. Not sure the ideal armrest material.

If Ethics means allowing insurance brokers to self certify that they qualified for 6 quarters of ERC then yes I found an ERC mill that indeed has Ethics. If Ethics means strict adherence to program guidelines as they describe it, then I think this one falls short.
I think I can safely say this is the most preposterous ERC position I have seen so far. Perhaps we need a preposterous statement tournament for ERC claims and ERC companies to compete and determine which is the most preposterous. Accepting nominations now!

it still blows my mind the number of people, who hadn't previously committed tax fraud, who took the ERC, when they were clearly ineligible, and walked away with $100k+ of fraudulently obtained money and here i am fretting over whether this $500 thing is deductible

I wouldn’t want to be a state at the bottom of the education spectrum telling highly educated CPAs from any state really that they can’t practice there because they didn’t comply with an incoherent rule that many of its own CPAs also are not in compliance with. But that’s me.

Everyone knows someone who should seriously consider the Voluntary Disclosure Program for ERC. Take the time. Reach out and share the benefits of the program ahead of the 3/22 deadline. The environment has shifted. People are aware of problems with ERC and receptive to VDP.

The provisions to claim ERC are under full or partial suspension. It’s pretty hard to say it’s a suspension when the government
@ajdtax @SmithMatthewC @danchodan @TheKron613 Is literally saying, “you can do whatever you want here, personal freedom is paramount.” The fact you may or may not have had customers be less comfortable because you didn’t have a mask mandate is not a partial suspension. There is a restriction of restrictions.
@ajdtax @danchodan @TheKron613 @yourfavecpa The notion that a customer may not want to transact due to the fact that they are freely able to do so and therefore that is a suspension is quite possibly the worst stretch of an argument I’ve ever heard in my entire life. Hell, it’s not like anyone published vax status.

The order must have the effect of suspending a TorB. This order does literally the opposite by preventing orders from obstructing commerce…

@RavenousTiger This is definitely primed for a “pound the table” strategy, because neither the facts nor the law are going to be on the taxpayer’s side here. And it’s going to be a bloodbath against the taxpayer if it makes it past some random IRS rank and file agent and into a courtroom.

@Camera0s @yourfavecpa @svpmatt I'm a nerd and it's fascinating to dig into these. But so far I'm not getting there. I can find history that these restrictions were in place in 2020 but nothing in 2021. And call me crazy, but if elective procedures were restricted in TX until 2023, I should see something.
