She says 7-11 has had a near-monopoly on gas stations in the Harmony corridor (it was built before city set standards that make it harder to put a gas station there) and they want to keep it that way.
But she adds there's also a Circle K in the same shopping center, so it doesn't make sense that adding the gas station at Sam's would conflict with the character of an area that already contains two gas stations

Now council needs to determine if P&Z properly interpreted the land use code. Francis: I think they applied it appropriately and at least one criteria (of six) was not met.

Arndt, Ohlson say they also think P&Z appropriately applied the land use code. Arndt: The Harmony Corridor plan was put in place before us. If we don't agree with it, we should work on changing it rather than constantly making exceptions.
A second motion to determine that P&Z appropriately applied land use code passes 6-1, with Peel voting no. The appeal is denied, so the Sam's Club gas station has been rejected.
Forgot to say why Peel voted no. She said she didn't feel there was enough explanation in the P&Z hearing transcript about why they thought the gas station proposal didn't meet the criteria in the land use code.
In other business, council cancels the Feb 1 meeting (the annual State of the City address will be held then) and moves to adjourn this meeting to next Monday, when they'll have an executive session to review city manager applicants and a public discussion of...
