A relatively rare Ontario Court of Appeal decision arising out of an LTB matter. The LTB Member did a sloppy job in granting eviction for a purchaser's use without looking at all appropriate factors. Tenants' appeal at C of A granted. #LTB @TenantAdvocacy coadecisions.ontariocourts.ca/coa/coa/en/ite…

The decison by the CoA affirms that the LTB has a duty to uphold the law and prevent tenants from becoming the victims of a bad faith eviction. Failing that, they must then take seriously tenant applications to sue a landlord for evicting them in bad faith.
The case is Elkins v. Van Wissen, 2023 ONCA 789 (Gillese, Benotto and Copeland JJ.A.) regarding a tenant application that had been dismissed by the LTB. The Court of Appeal found the LTB had erred in dismissing the case and has ordered it to return to the LTB for a new hearing!
Very proud to share that ACTO has secured a major legal victory at the Court of Appeal! This decision will have positive impact for tenants across Ontario in seeking justice if they are the victims of bad faith, own-use evictions by their landlord.
