🚨 A federal judge in PA has DENIED plaintiff ATS Tree Services’ motion to block the FTC’s rule banning worker noncompete agreements. Starting September 4, virtually all noncompete agreements across the country will be void. Big win for the FTC and tens of millions of workers.

The jury in Epic v Google deliberated for 4hrs before unanimously deciding Google is an illegal monopolist. Meanwhile, it’s been 6 months since proceedings ended in the Google Search case, and Judge Mehta has yet to issue a decision. Define “bad at deciding technical cases.”
Google's move is smart, and calculated to produce a better outcome. Juries are bad at deciding technical cases, and further they do not have the authority to order a breakup. The "law" (damages) and "equity" parts of the case are best separated; this motion facilitates that.

States then suggested maybe the real answer is 3) The default contract with Apple has to be huge because they are actually paying Apple to stay out of the search market. That's one clear way it would justify being so expensive.
Going further, states argued that if Google's previous arguments are correct, their search engine is so much better for users, and monetizes so much better, Apple has no leverage in these negotiations. Did Pichai ever suggest Apple should get *less* money from Google? No.
I'm at #USvGoogle this morning, we're on a brief break. A pretty funny exchange btwn the DOJ lawyer and Google CEO Sundar Pichai. When G heard Microsoft was planning to set MSN search as the default in their new browser, Google lawyer David Drummond sent them a long nastygram...
We do know it includes a provision stating that Apple must limit its own answering of search queries to a system "substantially similar" to status quo 2016. Pichai claims this means Apple can do "whatever it wanted" w its own search product. But that is not supported by the docs.
DOJ argues more narrowly that the effect of the agreement is in part to prevent Apple from entering search. On that, there seems to be a factual dispute about the meaning of the contract, but we the public can't see the contract. I assume/hope Judge Mehta can!
