A less legal thought: Some of the Justices express special concern about an ex-President being prosecuted 'because of the job.' It's odd, considering that generals and senators and other officials face similar issues, have less power and support, and have no immunity. 1/2
Legally it is odd as a "policy concern," because that's the main angle to add permanent immunity - it's not in the Constitution, Nixon didn't have it, Clinton didn't have it (special counsel negotiated a non-prosecution deal), etc
@AriMelber Some SCOTUS judges are trying really hard to justify giving Trump immunity.
@AriMelber Alito wants a stable democratic society? That’s rich
@AriMelber Even the Justices that Trump appointed aren’t immune from his wrath…if elected to a 2nd term, there’s zero evidence to believe that any of them would be immune from any & all of his perceived grievances.
@AriMelber @StephenGutowski Can’t wait to watch @AriMelber live later, it’s gonna be a banger 🔥
@AriMelber Well, if they rule on absolute immunity, Biden can easily order a hit on say....his opponent or even perhaps a supreme court justice (to correct a corruption problem), and be immune from prosecution.......
@AriMelber Yes - The presidency is an office with inherent constitutional powers consistent with our laws. When we elect someone to fill that office, we call them “President”. A president is limited to the powers of office and does not bring new powers to it.
@AriMelber ALITO: "I want to talk about this in the abstract...."
@AriMelber When you have corrupt judges this is what you get...Anything goes...
@AriMelber Alito thinks a former president needs total immunity in the off chance that a rando prosecutor brings a bad faith case against him and that would give him the sads.🙄🙄🙄🙄
@AriMelber You’re applying a standard of logic and reasoning to a decision that will be made by political hacks.
