𝗨𝗽𝗱𝗮𝘁𝗲 𝗼𝗻 𝗠𝗮𝗿𝗮𝘁𝗵𝗮 𝗥𝗲𝘀𝗲𝗿𝘃𝗮𝘁𝗶𝗼𝗻 𝗖𝗮𝘀𝗲 "50% 𝗿𝗲𝘀𝗲𝗿𝘃𝗮𝘁𝗶𝗼𝗻 𝗹𝗶𝗺𝗶𝘁 𝗶𝘀 𝗻𝗼𝘁 𝗶𝗻𝗳𝗹𝗲𝘅𝗶𝗯𝗹𝗲. 𝗜𝘁'𝘀 𝗻𝗼𝘁 𝗮 𝗰𝗼𝗻𝘀𝘁𝗶𝘁𝘂𝘁𝗶𝗼𝗻𝗮𝗹 𝗹𝗶𝗺𝗶𝘁. 𝗜𝘁 𝗰𝗮𝗻 𝗯𝗲 𝗯𝗿𝗲𝗮𝗰𝗵𝗲𝗱." -𝘀𝗮𝘆𝘀 𝗕𝗝𝗣 𝗚𝗼𝘃𝘁 𝗶𝗻 𝗕𝗼𝗺𝗯𝗮𝘆 𝗛𝗶𝗴𝗵 𝗖𝗼𝘂𝗿𝘁 Currently the total reservation in Maharashtra stands at 72%. Arguements are set to commence in Bombay High Court today. Maharashtra BJP govt in it's submissions before the High Court has strongly argued that 50% ceiling limit for caste quotas are not sacrosanct and the State has the power to exceed it. This is the 4th attempt (3rd attempt by BJP govt) in the state to exceed 50% limit. Despite the fact that Maratha quota has been stuck down thrice in the last 12 years - twice by the Bombay High Court and once by the Constitutional Bench of the Supreme Court. The 5 judge constitution bench in Jaishri Patil ruled that caste reservation cannot exceed 50% and Marathas are a forward community. Even after the constitution bench judgement in 2021, BJP govt once again increased the reservation beyond 50%. 𝗚𝗖𝘀 𝗮𝗰𝗿𝗼𝘀𝘀 𝘁𝗵𝗲 𝗰𝗼𝘂𝗻𝘁𝗿𝘆 𝘀𝗵𝗼𝘂𝗹𝗱 𝗿𝗲𝗮𝗹𝗶𝘇𝗲 𝘁𝗵𝗶𝘀 𝗼𝗿 𝗮𝗻𝘆 𝗼𝘁𝗵𝗲𝗿 𝗰𝗮𝘀𝗲 𝗿𝗲𝗹𝗮𝘁𝗲𝗱 𝘁𝗼 𝗯𝗿𝗲𝗮𝗰𝗵𝗶𝗻𝗴 50% 𝗶𝘀 𝗻𝗼𝘁 𝗮 𝘀𝘁𝗮𝘁𝗲 𝘀𝗽𝗲𝗰𝗶𝗳𝗶𝗰 𝗶𝘀𝘀𝘂𝗲. 𝗜𝘁 𝘄𝗶𝗹𝗹 𝗵𝗮𝘃𝗲 𝗿𝗲𝗽𝘂𝗿𝗰𝘂𝘀𝘀𝗶𝗼𝗻𝘀 𝗶𝗻 𝗲𝘃𝗲𝗿𝘆 𝗼𝘁𝗵𝗲𝗿 𝘀𝘁𝗮𝘁𝗲 𝗮𝗻𝗱 𝗻𝗮𝘁𝗶𝗼𝗻𝗮𝗹𝗹𝘆. 𝗕𝗝𝗣'𝘀 𝘀𝘁𝗮𝗻𝗱 𝗼𝗻 𝗰𝗮𝘀𝘁𝗲 𝗿𝗲𝘀𝗲𝗿𝘃𝗮𝘁𝗶𝗼𝗻 𝗶𝘀 𝗶𝗱𝗲𝗻𝘁𝗶𝗰𝗮𝗹 𝘁𝗼 𝗥𝗮𝗵𝘂𝗹 𝗚𝗮𝗻𝗱𝗵𝗶 𝗮𝗻𝗱 𝗮𝗹𝗹 𝗼𝘁𝗵𝗲𝗿 𝗼𝗽𝗽𝗼𝘀𝗶𝘁𝗶𝗼𝗻 𝗽𝗮𝗿𝘁𝗶𝗲𝘀 - 𝘁𝗵𝗲 𝗿𝗲𝘀𝗲𝗿𝘃𝗮𝘁𝗶𝗼𝗻 𝘀𝗵𝗼𝘂𝗹𝗱 𝗻𝗼𝘁 𝗯𝗲 𝗿𝗲𝘀𝘁𝗿𝗶𝗰𝘁𝗲𝗱 𝘁𝗼 50% 𝗮𝗻𝗱 𝘀𝗵𝗼𝘂𝗹𝗱 𝗴𝗼 𝗯𝗲𝘆𝗼𝗻𝗱 70%. BJP govts have been strongly defending the 50% breach in the states they rule - 73% quota in MP, 72% quota in Maharashtra, 75% quota in Bihar, 68% quota in Chhattisgarh, 64% quota in Rajasthan. There is only one difference between BJP and Rahul Gandhi: -Rahul Gandhi says there is a constitutional limit of 50% and if congress comes to power, he will bring a constitutional amendment to remove the 50% limit. -On the other hand, BJP's position is as such there is no constitutional limt of 50% quota and it can be exceeded even now and so there is no need of constitution amendment. BJP is in consensus with all other parties - Congress, Communists, DMK, RJP, SP, Muslim Leagur, AIMIM etc, when it come taking away the rights of General Category. Whether GCs should not have consensus against the political establishment?
