Even if the patent expires, i can't imagine any modern developer would want to put in the work or effort to implement it into their game. With how games have been going lately, for all the effort, it'd be more of a liability to them. Or it'd end up being a watered down version.

Don't get me wrong, I love those games and I've played well over a thousand games in my life. But there's a difference between games that take personal care to player expression and experimentation and ones that want you to do something exactly as intended. And one is better imo.
I often think about games like ffxiv where it's more like a choreographed dance rather than player expression. Where there very much is a "right" way to play. Where the only choice you get is what you decide to wear to the dance. Or ZZZ where combat gets increasingly conditional.
The problem is there shouldn't be a "right" or "wrong" way to play a game. If i play a game and have to play it the "right" way then what's the point of ME playing it vs watching someone on youtube.
One controversial yet meaningless opinion i have is that its absolutely possible to play games wrong and many people choose to play games wrong out of stubbornness and pride
