Recent USPTO changes risk handing U.S. technological leadership over to China. The Inter Partes Review process defends against low-quality foreign patentsāgutting it empowers foreign hedge funds and bad actors who shake down American businesses. š°
The USPTO is regularly rejecting IPR petitions from U.S. companies due to "resource constraints"āyet itās greenlighting 5 challenges from Chinese firm Zhuhai CosMX. So, no time to help U.S. firms fight invalid patents, but plenty to mediate disputes between Chinese companies?š
Since early 2025, the USPTOāunder the guise of āefficiencyāāhas gutted accountability measures like Inter Partes Review, leaving U.S. companies vulnerable to abusive litigation, often by foreign-backed patent trolls. This threatens U.S. national security and innovation. š
Chinese entities like Huawei and ZTEāknown national security threatsāhold massive U.S. patent portfolios. They have weaponized our own legal system against American companies. Recent USPTO changes empower these bad actors, putting the U.S. economy and innovation at risk.
The USPTO has gutted the IPR processāletting a single political appointee block cases based on vague, subjective criteria. This benefits mostly foreign patent holders at the expense of U.S. businesses and consumers. āWorkloadā is no excuse for weakening our entire patent system.
China orchestrated a flood of low-quality U.S. patent filings, driven by subsidies & mandatesānot innovation. Chinese enterprises were ordered to double U.S. holdings by 2025, making Chinese entities major players in our systemāat the expense of American businesses.
The USPTO has gone rogueāslashing examiner resources, gutting training, and fast-tracking patent approvals. The result?šA flood of low-quality patents, many issued to foreign entities. U.S. innovation is under siege. Itās time to reverse course and restore balance.ā
