𝗖𝗵𝗵𝗮𝘁𝘁𝗶𝘀𝗴𝗮𝗿𝗵: 𝗔 𝗦𝘁𝗿𝗮𝗻𝗴𝗲 𝗦𝗶𝘁𝘂𝗮𝘁𝗶𝗼𝗻 𝗥𝗲𝗴𝗮𝗿𝗱𝗶𝗻𝗴 𝗥𝗲𝘀𝗲𝗿𝘃𝗮𝘁𝗶𝗼𝗻 𝗢𝗻𝗲 𝗦𝘁𝗮𝘁𝗲, 𝗧𝘄𝗼 𝗥𝗲𝘀𝗲𝗿𝘃𝗮𝘁𝗶𝗼𝗻 𝗣𝗼𝗹𝗶𝗰𝗶𝗲𝘀?? A Timeline of Events Raising Serious Constitutional Questions: 1. 𝗡𝗼𝘃𝗲𝗺𝗯𝗲𝗿 2012 | 𝗥𝗲𝘀𝗲𝗿𝘃𝗮𝘁𝗶𝗼𝗻 𝗜𝗻𝗰𝗿𝗲𝗮𝘀𝗲𝗱 Chhattisgarh increased reservation from 50% to 58%. In certain district-level recruitments in Scheduled Areas, reservation reportedly reached 80%. 2. 19 𝗦𝗲𝗽𝘁𝗲𝗺𝗯𝗲𝗿 2022 | 𝗛𝗶𝗴𝗵 𝗖𝗼𝘂𝗿𝘁 𝗝𝘂𝗱𝗴e𝗺𝗲𝗻𝘁 The Chhattisgarh High Court, in WPC No. 591/2012 and WPC No. 4665/2019, struck down the impugned enhanced reservation framework. 3. 2022 | 𝗦𝘁𝗮𝘁𝗲 𝗔𝗽𝗽𝗿𝗼𝗮𝗰𝗵𝗲𝘀 𝘁𝗵𝗲 𝗦𝘂𝗽𝗿𝗲𝗺𝗲 𝗖𝗼𝘂𝗿𝘁 The State challenged the High Court judgment before the Supreme Court in SLP No. 19668/2022. However, filing an appeal does not, by itself, stay the judgment under challenge. 4. 1 𝗠𝗮𝘆 2023 | 𝗦𝘂𝗽𝗿𝗲𝗺𝗲 𝗖𝗼𝘂𝗿𝘁 𝗢𝗿𝗱𝗲𝗿 The Supreme Court permitted the State to proceed with certain recruitment processes advertised before the High Court judgment, subject to the terms of its order. This was not a blanket stay of the High Court judgment. 5. 𝗔 𝗖𝗼𝗻𝘁𝗶𝗻𝘂𝗶𝗻𝗴 𝗤𝘂𝗲𝘀𝘁𝗶𝗼𝗻 | 𝗘𝗻𝗵𝗮𝗻𝗰𝗲𝗱 𝗥𝗲𝘀𝗲𝗿𝘃𝗮𝘁𝗶𝗼𝗻 Despite the High Court judgment, the State has continued applying enhanced reservation provisions in certain recruitment and admission processes. This raises questions about the legal basis for such implementation. 6. 𝗧𝘄𝗼 𝗗𝗶𝗳𝗳𝗲𝗿𝗲𝗻𝘁 𝗣𝗿𝗮𝗰𝘁𝗶𝗰𝗲𝘀? In certain recruitment processes, the Chhattisgarh High Court has followed the pre-amendment 50% reservation framework, while the State Government has continued applying enhanced reservation in some other processes. 7. 𝗡𝗼 𝗦𝘁𝗮𝘆, 𝗬𝗲𝘁 𝗗𝗶𝗳𝗳𝗲𝗿𝗲𝗻𝘁 𝗣𝗿𝗮𝗰𝘁𝗶𝗰𝗲𝘀? A three-Judge committee of the High Court reportedly clarified that no stay had been granted against the judgment. Yet the question of compliance with that judgment continues to arise. 8. 𝗦𝘂𝗽𝗿𝗲𝗺𝗲 𝗖𝗼𝘂𝗿𝘁 𝗙𝗶𝗻𝗮𝗹 𝗛𝗲𝗮𝗿𝗶𝗻𝗴 𝗔𝘄𝗮𝗶𝘁𝗲𝗱 The final resolution of the pending dispute remains crucial. A clear judicial determination is needed to settle the uncertainty surrounding the applicable reservation framework. 𝗧𝗵𝗲 𝗙𝘂𝗻𝗱𝗮𝗺𝗲𝗻𝘁𝗮𝗹 𝗤𝘂𝗲𝘀𝘁𝗶𝗼𝗻 Can two different reservation frameworks operate simultaneously within the same State under the same legal framework? When a High Court judgment remains unstayed, its legal consequences cannot be ignored merely because an appeal is pending. The State's actions must be examined in light of the actual judicial orders, applicable law and constitutional principles. 𝗧𝗵𝗲 𝗽𝗲𝗼𝗽𝗹𝗲 𝗼𝗳 𝗖𝗵𝗵𝗮𝘁𝘁𝗶𝘀𝗴𝗮𝗿𝗵 𝗱𝗲𝘀𝗲𝗿𝘃𝗲 𝗹𝗲𝗴𝗮𝗹 𝗰𝗹𝗮𝗿𝗶𝘁𝘆, 𝗰𝗼𝗻𝘀𝗶𝘀𝘁𝗲𝗻𝗰𝘆 𝗮𝗻𝗱 𝗰𝗲𝗿𝘁𝗮𝗶𝗻𝘁𝘆 𝗶𝗻 𝗺𝗮𝘁𝘁𝗲𝗿𝘀 𝗼𝗳 𝗿𝗲𝘀𝗲𝗿𝘃𝗮𝘁𝗶𝗼𝗻.

A Massive Victory for Merit! ⚖️🔥 The blatantly unconstitutional 91% reservation in UP's 4 SCP Medical Colleges has been officially struck down! The previous NEET-UG allotments stand cancelled, and a fresh counselling schedule has been issued, returning the quota to the statutory 50% limit. Let's be clear: this was not a gift from the government. उत्तरप्रदेश 4 मेडिकल कॉलेज में बढ़े आरक्षण के मामले में भ्रम फैलाया जा रहा है! बता दें कि हम 91% आरक्षण चैलेंज नहीं कर रहे! वो आलरेडी चैलेंज किया हुआ है कोर्ट में! हम सरकार द्वारा अपनी दी गयी undertaking को breach करने को चैलेंज कर रहे हैं, जिसमें कोर्ट में सरकार ने कहा था कि नए सत्र में सही आरक्षण लागू होगा! ये contempt of court है, कोर्ट के सामने जो undertaking दी थी, उसी का उल्लंघन कर रही है सरकार!
