Clarifications have been sought by us (#PARWA) from District Town & Country Planning Dept. Haryana and TCP Gurugram with respect to the License no. 268 of 2007 dated 3.12.2007. We hope to receive their reply.

The builder #Pioneer #Urban purposely and knowingly ignores the RWA and the request to handover the common area maintenance to the Residents Association. Next step....non-cooperation movement!!! Will the residents of the society unite for a just cause is to be seen.

PARWA has written to builder Pioneer#Urban# to handover Common Area Maintenance to the RWA. Last OC was received in Feb 2019. More than 3 years with substandard maintenance isn't acceptable anymore. Residents want to take control themselves. Will the builder handover amicably?

What should the RWA do if the builder wilfully & purposely ignores them and refuses to talk to them, because they do not want to handover the common area maintenance? Stop paying the maintenance fee to them, is the option. Be ready to step in. RWA is within the laws to takeover.

The Builder #Pioneer #Urban at the time of possession made/forced everyone to sign a maintenance agreement valid for 3 years. The 3 years has elapsed for some and the agreement has expired. They threaten to enforce some clauses like 18% interest on delayed payments. Illegal?

Owners of Presidia have approached PARWA to file a legal case against the Builder. Case has been filed at NCDRC.

Several Owners at Araya and Presidia have filed individual cases against Pioneer Urban Land and Infrastructure Limited, the builder for recovery of proper delay compensation. Many have won the compensation. Several are awaiting decision.

Builder - Pioneer Urban - has appointed its own subsidiary to maintain the complex and forced everyone to sign a maintenance contract (without which possession of flats are denied) and also forced owners to provide a full one year advance of the maintenance charges. What a scam.

Builder claims that community Club at Presidia & Araya is owned by them and they shall run it as a private club. They have the right to refuse membership to residents as well as open it to members of the public. Is it legal to use complex land for commercial business gains?

Residents are getting stuck in #Lifts, an everyday occurrence in our complex. #Pioneer #Urban the builder says UPS or EDR is not mandatory. Their appointed management agency refuses the need for EDR, saying lifts are working fine. Then why do residents face such harrowing issues?

#Pioneer #Urban appointed its own subsidiary PFML to maintain the #Presidia #Araya Residential Complex and charge residents 1.2 x of all costs. PFML appointed C&W / CBRE to manage in turn everything. 20% of costs is net revenue for builder's subsidiary. Keep fleecing residents.
