I think it's a critique of rhetorical strategies, rather than a statement of his positions. Since the enlightenment, western philosophical tradition has focused on deconstructing theological justifications of law, and replacing these justifications with moral arguments. Whereas a mediaeval European may consider "It is wrong to steal because it violates God's commandments", a post enlightenment European may consider "It is wrong to steal because I don't like when others steal from me. By principle of the golden rule, I must oppose theft". This is of course, a wide generalization, but I think it points to the heart of the critique.
