If I were about 25 years younger, I would jump at the chance to work with @ruthgreenwood and @ProfNickStephan at @ElectionClinic . Ruth, Nick, and the team they have assembled is as unique as it is vital. I strongly urge any lawyer with an interest in election law to apply!

Come work with @ruthgreenwood and me! @ElectionClinic has been doing innovative election law litigation and advocacy for the last three years. This is a rare opportunity to join the ELC team.

Huzzah, the county line is dead! (Barring something unexpected like a longshot SCOTUS intervention.)

This clause would remove like 95% of the annoyances from publishing with law reviews. It would also focus student editors on the areas where they add (not arguably subtract) value.

This is the third time SCOTUS has denied cert in a case alleging the unconstitutionality of a state voting rights act. It seems -- fortunately! -- that this just isn't an issue the Court cares about. FYI, here's @ruthgreenwood's and my article on SVRAs: papers.ssrn.com/sol3/papers.cf…

I don’t want to hear conservatives complaining that Congress lacks the necessary authority when Democrats next try to pass a law facilitating voting, stopping gerrymandering, reviving the Voting Rights Act, etc.

In Australia, according to @SimonJackman, precinct-level results update in real time as the vote is counted. Truly a magical land!

Papers like this testing courts’ and lawyers’ empirical claims about governance are very valuable. In my contribution to this genre, I skeptically examine the Court’s claims about accountability — in both administrative law and other areas of public law. papers.ssrn.com/sol3/papers.cf…

This is the absurd consequence of the county line defenders’ position. If parties have a constitutional right to convey their endorsements, on the ballot, by bracketing candidates, then they could demand an end to the office block ballots used by the other 49 states.

Good to see bipartisan consensus that the federal government can regulate voting qualifications. (In this case, federal law already bans non-citizen voting, so the Trump/Johnson proposal is apparently to copy, paste, and reenact an existing provision.)

Relatedly, since when do progressive lawyers build their arguments on Trumpist rulings (like Jacobson) that manipulative ballot designs are okay? Isn’t the point of progressive election lawyering to resist — not expand — those antidemocratic decisions?

This is like one of the classic bad arguments against gerrymandering: If you don't like it, just vote out the gerrymanderers. The whole point of gerrymandering -- and the county line -- is that they distort election outcomes to protect favored candidates.

A centrist third party could certainly work *given a different electoral system*. It's winner-take-all elections -- not Americans' underlying preferences -- that give us two dominant parties.

We just won our county line case at the 3rd Circuit ! Honored to fight for democracy alongside Flavio Komuves and @YaelBromberg, with the support of countless advocates, organizations, and the public at large. We just accomplished what everyone said was impossible!
The Third Circuit UNANIMOUSLY affirms the District Court's order granting the preliminary injunction: "its findings of fact are substantiated, its conclusions of law are sound, and its ultimate decision granting the injunction presents no abuse of discretion." #LineABOLISHED
BREAKING: Until recently not enough people understood NJ’s anti-democratic “county line.” Until we all did. Then The People refused to accept it. @YaelBromberg, @bmpugach & Flavio challenged it. The 3rd Circuit just upheld striking it down for EVERY RACE in NJ’s 6/4 primary!
We are so proud to announce that SDRI Co-Director @MiriamSeifter has been awarded the @acslaw Ruth Bader Ginsburg Scholar Award for her important scholarship on democracy!

@ProfNickStephan Which is easier for the editors: To rearrange sentences arbitrarily for supposed stylistic enhancement, or to think of, say, possible counter-arguments, and see whether there's any support in the case law?
@ProfNickStephan Need: “[Law Review] will not demand or insert parenthetical descriptions of cited sources, as these are at best superfluous.”

@Debbie_Hellman and I have posted a new paper on race-conscious admissions after the Supreme Court's decision in SFFA: ssrn.com/abstract=47924…. We explore what the decision does and doesn't allow and what it says about the broader state of equal protection law. 1/

@ProfNickStephan And the time stamped, progressive national count is archived in a monster zip archive of XML files. Key input into election night projections and post election research. Great to spend time here working with the precinct (polling place) level data rather than compiling it.
@ProfNickStephan One of my favorite papers--I've cited it before in a similar paper on the nondelegation doctrine (cornelllawreview.org/wp-content/upl…), which reminds me I need to add a citation here!

Such a stupid way to select a head of government.
If Nebraska had gone winner-take-all, Trump would only need to flip AZ, GA, & NV to tie the Electoral College. The House GOP could then elect Trump—each state gets 1 vote & gerrymandering nearly guarantees GOP control of 26 states. But currently, he needs 1 of MI, PA, or WI too
We have hit the 50% tipping point where the majority of Defendant-Clerks have withdrawn from their appeal before the Third Circuit. 10 have withdrawn, 9 formally remain (although there have been news reports that some of those will withdraw). #Abolishtheline Withdrawals Below:
