It is scandalous that the Scottish Government has shortlisted four Turkish and Chinese shipbuilding firms for two lifeline Northern Isles ferries when it can and should be awarded to a UK shipyard. Rerun this as a UK-only competition under Section 45 of the Subsidy Control Act.

What makes the Harland & Wolff rescue deal so difficult is that it’ll set a post Brexit legal precedent. State aid law will apply under the NI Protocol, but so might the EU Foreign Subsidies Regulation & possibly Subsidy Control law (as shipyards outside NI will be safeguarded).

Do you remember Brexiteers promising EU regional regeneration funding wouldn’t be lost if the UK left the EU? That promise is about to be broken. First the replacement fund, UKSPF, was smaller than the EU funds. Now Conservatives will scrap UKSPF to pay for national service.

@DaleVince I’m really pleased to see @DaleVince refer the Subsidy Control Act 2022, because this legislation ought to be changed so it makes public authorities consider the environmental impact of subsidies. Such an amendment was narrowly defeated in 2022 (see below).

The Subsidy Advice Unit has assessed 36 measures so far. 66% of reports criticised how public authorities considered principles A, C and F, whilst 50% of reports criticised Principles B, E and G. Does this indicate public authorities are struggling to properly apply the rules?

DESNZ has referred yet another subsidy scheme to the CMA in which the value of the subsidies on offer is unclear. In this case the value is stated to be somewhere between £100m - £2bn, making it almost impossible for competitors to gauge the likely impact on their businesses.

@ClientEarth It’s an example of how the Subsidy Control Act 2022 isn’t sufficiently robust when it comes to environmental matters. You may recall that a @Peers4Planet amendment, which would have required public authorities to consider the environmental impact of subsidies was defeated. 3/4

The notification obligations in the EU Foreign Subsidies Regulation have now been in force for over 100 days. The European Commission has revealed that in this time there have been 53 cases - 9 have led to detailed assessments and one is the subject of an in-depth investigation.
