@DooopDouble @democracycoma1 @Barristerblog I concluded that S.41 was an improvement under the old law of S.2, but that the decision in R v A (No 2) muddied the waters somewhat and so, consequently, I concluded that S.41 requires reformation to protect complainants and defendants

@Barristerblog I should have added that the focus of the analysis was whether the provisions go far enough to balance the rights of complainants against the defendants right to a fair trial

@BarristerSecret I agree that allowing juries to give reasons would go some way as to improving the transparency of the system; but wouldn’t it mean that appellate courts could simply look at a juries reasoning and substitute their own, effectively leaving trial by jury redundant?

BUT, does that mean what's happening in Bristol is right? Absolutely not. By 'rioting' (which I may do another tweet on), protesters are playing into the hands of the very people who seek to limit their right to protest by giving them a PR goldmine. [10/11]
