According to Asplin, Etherton et al arbitrage doesn't exist. But this is the barristers fault too because they don't understand the key finance aspects. On appeal it should have been a dawdle to overturn Asplin.

Despite legislation and case law,it appears that the mortgagee’s rights prevail. This explains why they refuse to further legislate to protect mortgagors from repossession and influence regulation

Ive been thinking about the term home owner It is assumed that once a house is bought with the assistance of a mortgage, one is a home owner or at least the Government classes them as a home owner (1)

The fact is one is a home buyer with a mortgage and this is the true reality. When the Government states it wants one to buy their own house it is referring to one becoming a homebuyer as opposed to a homeowner. The curiosity in me asks why is that, then the penny dropped (2)

The Government has a definite conflict of interest in the matter in that as the owner or major shareholder in several banks that makes it the largest mortgagee in the country, it has a financial interest in speeding up repossession and sales of repossessed homes. (3)
