But hard to see how the statement that “academic commentary or scholarship … is not properly the subject of judicial notice” squares with Le at paras. 82-89, which recognizes that “authoritative studies, research and articles” can establish social context via judicial notice

Pretty remarkable result — leave to cross-appeal granted based on a request in the hearing and full-indemnity costs throughout. I'm glad the SCC saw what was clearly the right result. I just hope that 6 years later, CCD and its counsel still have the will to see this through.

Yes. The maple syrup thing is funny. But this area of law is messed up and can doom people to owe sums they will never be able to pay back for the rest of their lives, meaning that a jail sentence hangs over their heads for years—in addition to their actual sentence.
