I wrote up a prediction of how the Court may come out on the Trump immunity case. I don’t typically do this but cases like these come along once a century (except like four to five times in the Trump era). Could be right, could be wrong — we will see!
Just listened to the oral argument on the presidential immunity question. Some Sunday thoughts: 1. the ruling is going to be narrower than everyone suggests. Everyone agreed private actions aren’t covered; everyone agreed some small set of core functions cannot be prosecuted.
Brief update on SCOTUS hearing re: obstruction statute and January 6 conduct. Thomas, Sotomayor, Kagan, Barrett, Jackson skeptical that “otherwise impedes an official proceeding” doesn’t cover January 6 . Alito is literally trying to help the attorney remember his arguments.

A lot of these headlines are a bit misleading. It is not illegal under U.S. law to achieve or maintain a monopoly. What's illegal is anti-competitive, exclusionary conduct, which is what the DOJ accuses Apple of here.

It's time for our leaders in law and politics to be honest about the courts. Law is a process, not a journey in seek of truth. When judges make bad decisions, it is absolutely appropriate to criticize them. Otherwise, we're just surrendering to their rule.
It's worth asking what the ad nauseam insistences that we "respect courts" and "not give up on courts" have actually achieved. Has it created a more fair or stable judicial system? No, all it's done is reinforce the idea that progressive should always lose, and never fight back.
@newrepublic Yet still the reflex of many in law and politics is to simply sit by, to commit more to a non-existent myth about judicial neutrality than to the obvious reality that everyone can see right before their eyes.
@newrepublic It's so rich for the Supreme Court to rule that disqualifying Trump would be too "chaotic" when the same justices have spent their whole careers wreaking absolute havoc on our political and judicial systems. What more proof do we need that conservative jurisprudence is a fraud?

Everything that is wrong with legal punditry in a nutshell.
There are a lot of reasons for this, but it begins w/ the conception—drilled into the heads of lawyers starting in law school—that “law” is about discovering some universal truth, rather than a series of choices made my human beings.
Honest question: why do the networks still all have legal analysts who try and analyze the Supreme Court through a legal lens, when the Court has repeatedly made clear it is a political body working to benefit Republicans?
