It's over...... The SCOTUS already has a J6 case, on practically this subject. The CO and J6 case are basically tied to 'insurrection' clause. How can SCOTUS rule one way on one and another way on the other? Does having a intent to overthrow the government matter for it to be an 'insurrection' ? Yes. Would any reasonable person believe it could succeed? No. SCOTUS going to have to rule that J6 was NOT an insurrection by legal definition. Then, most of it goes away. SCOTUS thought they only had Jack Smith pressuring them for time. Now this, and before Jan 4, at that...... 2024 will start off with quite the bang.

@jeffcharlesjr Scotus will smack it down if the first appeals court doesn’t. They don’t seem to get that you can’t let state AGs decide on their own that a presidential candidate is ineligible. Red states could removing Biden is ineligible because of corruption. No conviction needed
