A lot has been said about Peter and Jude’s or, forgive me, Judas’ ase, and I do not need to go into all the nitty-gritty. Let me state my bias upfront: based on everything I have watched and read, I believe Jude did a lot wrong and should take most of the blame for how things got here. I arrived at this conclusion after considering Peter’s Season series, Jude’s rather lame response, Tony’s Instagram message and the interview granted by Henry, their eldest brother. I have also seen several online commentaries. Some are probably paid, while others come from people who are so loud on politics and activism that they now consider themselves the custodians of wisdom. You can hardly challenge their position without getting insulted. However, one important point many of these commentators seem to have missed is that the cases before the courts are not simply Peter versus Jude. These are criminal cases being prosecuted by the EFCC against Jude and his company. Peter submitted the petition and remains a key prosecution witness, but he is not personally prosecuting Jude. I am not a lawyer, but this is my little understanding of how it works: when someone submits a petition to a law-enforcement agency, the agency investigates the allegations. If it cannot establish a basis for any of the claims, it may close the matter. Where it finds that some allegations cannot be supported but believes others should be tested in court, it may reject the unsupported ones and file charges based on the others. That appears to be what happened here. Yes, the EFCC reportedly said it could not substantiate some of Peter’s specific claims, including the alleged $800,000 withdrawal and the claim about 47 bank accounts. That should not be ignored. Peter’s testimony has also been challenged under cross-examination, and it is for the court to determine what is credible. However, saying that “the EFCC threw Peter’s complaint away” is not accurate. The EFCC may not have pursued every allegation contained in Peter’s petition, but it proceeded with other allegations it believed were serious enough to take before the courts. Some people appear to believe that because one allegation could not be substantiated, the entire case has disappeared. No. Peter made several allegations. Some may not have had enough supporting evidence, but others resulted in criminal charges relating to alleged money laundering, stealing and conversion of royalties. Of course, taking someone to court is not proof of guilt. Jude has pleaded not guilty and, like every accused person, he is presumed innocent until proven guilty. The prosecution must still prove its case beyond reasonable doubt. But the presumption of innocence does not mean the rest of us must pretend that nothing questionable happened. It does not prevent us from considering the available information, the explanations given and the surrounding circumstances, and forming our own opinions. People are free to support Jude, but they should stop rewriting the story as though Peter simply woke up one morning, manufactured some allegations and personally dragged his brother to court. Peter submitted a petition. The EFCC investigated it. Some allegations were not pursued, while others resulted in criminal charges. Jude pleaded not guilty. Now, the courts will determine whether the prosecution can prove those charges. Until then, this remains my personal opinion: from everything I have seen, I believe Jude did plenty wrong. A criminal charge is not proof of guilt, but shouting “family matter” or attacking Peter is not proof of Jude’s innocence either. FG no get time to dey carry every family quarrel go play for court.
