The Supreme Court of Canada is not in the “error review” business: it’s in the “jurisprudential business”. As a consequence of making authoritative statements on the law in Canada, it will sometimes correct an error. The SCC granted leave because they want to comment on it.
The Supreme Court can’t just decide to hear the Federal government’s appeal of the previous rulings against their use of the Emergencies Act on a whim. There has to be an error in law made by the Federal Court of Appeals. All 3 of those judges ruled unanimously against the

@Marxchosias @IanRunkle By “defend yourself against a judge” I assume you mean “justify your actions before a judge” because you aren’t “against” a judge.
@IanRunkle If you’re requesting to be exempt from the law (don’t murder/harm someone) it’s not unreasonable to be asked to justify that, potentially in a court of law. Even under your “Runkle Rule”, someone still has to make the decision whether the force used “shocks the conscious”.
Unironically Jeff’s principle here would be disastrous to the separatists’ voter turnout.

@DarrenBurchill Pointing out that a public law duty is not a private law duty is not agreeing with Eva, it’s pointing out that she’s, at best, disingenuous with her framing, and at worst being intellectually dishonest, to the detriment of her followers.
What Eva is leaving out is that there is a private law duty of care between those who are incarcerated and Corrections Canada (which, based on proximity and foreseeability, duh) and that there is no private law duty of care between the government and people writ large.
This is Canada: prisoners get the opportunity to question the government over pandemic measures, while law-abiding citizens, including those who were injured, are essentially told the government “did its best.” People who challenged pandemic restrictions were beaten, charged,

@echipiuk If this decision is as bad as you’re suggesting, you’d have filed a Notice of Appeal already. You’re yelling about it on Twitter. That says all anyone reasonable informed on the law needs to know.
@echipiuk Your pleadings didn’t disclose any direct interactions between your client and the government (paragraph 68). Seems like you’d need to do that to establish an arguable duty of care for the purposes of a class certification proceeding.
Generally speaking it helps to establish a duty of care, and get past the first step of the class certification test, if you can point to (or even plead) facts showing a direct connection between your client and the government (see paragraph 68 of the decision).
Read this carefully. This person is making my point for me. Their argument is that the government owes a duty of care to prisoners, but no private law duty of care to the public at large—including law-abiding citizens harmed after complying with government demands. Think about

If the decision was as terrible as you claim it was you’d have filed a Notice of Appeal already. You’re yelling about it on Twitter which would tell any reasonably informed observer all they need to know.
