The Trial Panel has ruled that part of the criminal purpose of the JCE Members and "others in the KLA leadership" was to achieve Kosovo’s independence through war crimes. Even the Prosecution did not go this far. So @mprelec is partly right that the court did not declare Kosovo's right to independence illegal (it had no jurisdiction to do so), but it did declare that the means used to achieve Kosovo’s independence were, in substantial part, criminal.

Whether the Kosovo Specialist Chambers has acted impartially in Mr Thaci’s case is yet to be determined. It is not for Marta Kos to prejudge that issue. Hashim Thaçi wishes to express his sincere appreciation for the outpouring of support he and Kadri Veseli, Rexhep Selimi and Jakup Krasniqi have received from the people of Kosovo and internationally, and calls upon Kosovo’s citizens to remain peaceful in response to yesterday’s injustice. Mr. Thaçi’s lawyers will appeal yesterday’s Trial Judgment before the Appeals Panel of the Kosovo Specialist Chambers (KSC), asserting significant errors of law and fact that prejudiced the fairness of the proceedings. Throughout the trial, the Defence repeatedly raised concerns regarding procedural fairness, including the extensive scope of questioning conducted directly by members of the Trial Panel in a manner that did not create the appearance of impartiality. The Defence maintains that judicial interventions crossed the boundary of neutral truth-seeking, compromising the appearance of impartiality required under international standards of justice. That lack of impartiality now permeates the Trial Panel’s Judgment. The Defence submits that the Trial Panel’s findings of guilt beyond a reasonable doubt rely on insufficient and uncorroborated evidence. Moreover, the Trial Panel yesterday publicly claimed that Mr. Thaçi was involved in the murder of Behajdin Allaqi after having ordered all parties in the case not to discuss the case of Mr. Allaqi in public session in court, and after having ordered all of the evidence related to that case to be kept confidential. The Trial Panel has thus publicly convicted Mr. Thaçi of a murder while also keeping the evidence on which it drew this conclusion shielded from public scrutiny. Mr. Thaçi would welcome such public scrutiny of the evidence. The Defence will appeal the Trial Panel’s decisions for violating his fundamental fair trial rights under the European Convention on Human Rights and the Kosovo Constitution. Mr. Thaçi expressly denies any involvement in murders. Adherence to rigorous standards of procedural fairness is vital to maintaining public confidence in international criminal institutions. The Defence will formally submit its Notice of Appeal to correct these factual, legal and procedural errors before the Appeals Panel.

Today’s judgment against the former Kosova Liberation Army leaders, Hashim Thaçi, Kadri Veseli, Rexhep Selimi and Jakup Krasniqi, is a travesty of justice that must be corrected on appeal as soon as possible. The entire saga of the so-called Specialist Chambers began in 2008, with far-fetched allegations of organ trafficking brought before the Council of Europe by Russian parliamentarian Konstantin Kosachev and Serbian parliamentarian Miloš Aligrudić. These allegations were so absurd that they did not even make it into the Prosecution’s indictment due to lack of evidence. Crucially, today's judgment also rejected the most serious allegation remaining in the Prosecution’s outlandish litany of charges: that the KLA had launched a widespread, systematic attack against a civilian population. This basic prerequisite for establishing crimes against humanity was therefore unfulfilled. The Court also made clear that it did not pass judgment on the legitimacy or justice of our war of liberation. Instead, the convictions relate to specific charges of war crimes, including the detention of persons considered collaborators of the Serbian regime. These findings are unjust and offensive, but they are not final. The gross injustice of the Prosecution's charges has been repeatedly noted not only in Kosova, but also by renowned international figures who witnessed the conflict first hand and testified before the court: the KLA and its leaders were a bulwark against brutal repression against Albanians — not the perpetrators of criminal acts. These first-hand accounts underscore that today's judgment rests on fundamentally flawed foundations, both historically and legally. This judgment cannot be separated from the history that gave rise to the KLA. The people of Kosova endured the loss autonomy, expulsion from institutions, imprisonment, torture, killings, ethnic cleansing, and ultimately, genocide. For over a century, numerous Serbian state programs and policies aimed at the elimination of ethnic Albanians. This brutal repression was not a backdrop to the war, it was the reality that made resistance a matter of survival. And yet, the Specialist Chambers’ work has focused on only one side of the war. When members of a single ethnic group sit in the docket, while the state apparatus that perpetrated massacres, expulsions and genocidal crimes remains untouched, the inevitable result is both the fact and the appearance of mono-ethnic justice. This has only been reinforced by the lack of transparency of a trial, significant parts of which took place completely out of public view and thus without public scrutiny. As we have done since the start of this process, Kosova’s Government will continue, with all the means at its disposal, to support the accused in the appeal proceedings, where we expect this injustice to be fully corrected.

All attempts to create a false equivalence between Kosovo's liberation struggle and Milosevic's genocidal regime are destined to fail.

The Special Court rules: There were no crimes against humanity committed by the Kosovo Liberation Army leaders.

Unbelievable yet all too believable. Serbian clubs should be thrown out of all European football competitions. Glorification of heinous war criminals has no place in Europe.

Today, I had my first meeting with @SecGenNATO Mark Rutte in my capacity as Minister for Europe and Foreign Affairs, at a time when #Albania continues to deepen its engagement and responsibilities within the #Alliance. We shared the view that, in today’s increasingly complex and unpredictable security environment, #NATO is more relevant and indispensable than ever. Strengthening collective defence, increasing defence spending, supporting #Ukraine, and expanding defence industrial capacities remain central priorities for preserving deterrence, resilience, and transatlantic security. #Albania has consistently proven itself a reliable, committed, and active #Ally. Our contribution to collective security continues to grow through increased defence investments, the modernisation of our #ArmedForces, and active participation in Allied missions and operations. Building on this trajectory, Albania remains fully committed to further strengthening its defence capabilities and ensuring that our commitments translate into concrete operational readiness that enhances both national and Allied security. We also stressed the importance of maintaining a strong and unified strategic focus on #Ukraine. Albania remains fully aligned with Allied efforts to provide sustained support through NATO mechanisms, including training, assistance, and long-term capacity-building, as part of our broader commitment to defending the rules-based international order. I congratulated her on the TISZA Party’s overwhelming victory, and we agreed that EU integration of the Western Balkans is key to regional stability.
