I have been a criminal and civil lawyer for more than 31 years. Here are my preliminary observations on the conviction of Okoth Obado. My opinion is intended to raise critical issues which arise from Obado’s conviction. These are my opinions based on the evidence the prosecution tabled and the judgment as read by the judge on July 23, 2026: The individuals who committed the murder were not arrested and tried. There were no confessions by anyone directly involved linking Obado to the crime. No DNA or any other physical evidence linked Obado to the crime. The electronic evidence adduced by the prosecution and witnesses who testified showed that Obado was in Nairobi when Sharon was murdered in Homa Bay county. In other words, the evidence by the prosecution corroborated Obado’s alibi. There was absolutely no material evidence adduced in court that Obado gave any instructions to the two co-accused to kidnap, harm or kill Sharon. None. The alleged “funding” and “logistics” linked the co-accused to Sharon but not to Obado. The Nation Media Group stringer who miraculously “escaped” from the vehicle where Sharon was kidnapped implicated the two accused but not Obado. Murder is one of the gravest offences in the statute books. Proving it requires meticulously presented evidence which leaves no doubt on the guilt of the perpetrator. One ought to be convicted of it by concrete overwhelming evidence that proves the allegations BEYOND ANY REASONABLE DOUBT. Only then can we say justice has been done for the victims. Therefore question some of us are asking is: where is the circumstantial evidence which proves the crime of murder of Sharon by Obado beyond any reasonable doubt? Is pregnating Sharon proof of murder? If that were the case, there are perhaps thousands of men in Kenya who would be in jail because some of the women they had impregnated and failed to take responsibility for ended up as victims of crime. Is refusing to marry Sharon or to support her financially (if proven), proof of murder beyond any reasonable doubt? Again millions of Kenyan men would stand convicted if their failure to support those they had impregnated who ended up being murdered constituted “circumstantial evidence” as to their guilt. Is avoiding Sharon (if proven), proof of murder beyond any reasonable doubt? No. Just because Oyamo and Caspal worked for Obado is the proof beyond any reasonable doubt? Is Obado the only person Caspal and Oyamo worked for or with? Who were the other persons who would have had motive to harm or murder Sharon? Were they investigated? Were they charged and tried? Why not? In my considered opinion, Obado’s conviction will be overturned on appeal. The judge’s reasoning is incurably, irretrievably and fundamentally faulty—legally and logically. It’s also a material and serious misapprehension of the evidence. As William Blackstone wrote in 1765, “it’s better to let ten guilty persons go free than to convict one innocent man.” Later, Benjamin Franklin upgraded the number to 100. My considered view is that the Obado conviction will be set aside by the Court of Appeal. These are my views. They are founded on reason, analysis, logic, knowledge of the law and the evidence adduced.
