While attending few of the hearings in the CJI’s court, I have realised that judges like J. Bagchi hold the door open for the executive more nefariously than the current Chief Justice. While the latter is forthcoming in his brass observations, where one could easily sense his leaning over a matter, the former (J. Bagchi) plays a covert game of invoking intricate administrative technicalities to make grounds for the Executive to challenge the internal validity of established law. For example, “understanding protest site in light of technology”, “categorisation of journalists” are some carrots dangled by the bench infront of the SG. #SupremeCourtofIndia
