🚨UPDATE: THE FTC HAS RESPONDED TO ME IN WRITING🚨 THIS IS WHY WE DON’T STOP. I have now received a formal response from the FTC regarding the two formal letters I sent to Chairman Andrew Ferguson concerning HISA and its proposed 2027 budget, including my request to withhold approval pending an independent investigation. The FTC confirmed that ALL of the documents we submitted have been received and the record has been updated. And here is the important part: the FTC states that information in this database is regularly reviewed by its attorneys and investigators in determining potential law enforcement targets, policy recommendations and other action. Let me be clear: the FTC has NOT told me an investigation has been opened. But our evidence, questions and concerns are now documented and available for review by FTC attorneys and investigators. We also sent these formal letters and supporting information to select members of Congress. I am confident that, with the seriousness of the issues we have raised and the number of eyes now on them, there is a very good chance these matters receive the scrutiny they deserve. THIS IS WHY THE 99% DOESN’T STOP. We ask questions. We document the facts. We put them in front of the people with the authority to act. HISA can remain silent. We won’t. REFORM IS COMING! 🚨IMPORTANT…HISA WAS A FAILURE LONG BEFORE ANYONE HEARD THE NAME MARSHALL GRAMM.🚨 REPOST TO MAKE A DIFFERENCE! Let’s stop allowing the latest scandal to distract from the much bigger issue. The issue is HISA itself. This is the regulatory body The Jockey Club’s horse and buggy leadership helped push onto this industry, working closely with Kentucky Senator Mitch McConnell and Congressman Andy Barr to get it through Washington. McConnell made HISA a “top priority” in the Senate, and it ultimately became law as part of the massive year end government funding bill. How’s that working out for us? We were promised uniformity, integrity, efficiency and fairness. Instead, HISA has been stumbling since the starting gate opened, beginning with hiring a CEO with ZERO previous horse racing experience. HISA began without adequate financial backing and had to BORROW MONEY from major industry organizations. Some loans were repaid or forgiven. Approximately $4 MILLION remained outstanding as recently as April. And then there’s the conflict of interest elephant in the room. The Jockey Club, Breeders’ Cup and NTRA were among HISA’s biggest institutional supporters, and then became HISA’s lenders. CEO Lisa Lazarus dismisses conflict concerns by saying HISA operates independently. That’s not good enough. When organizations that helped create a regulator also help finance that regulator, with millions still outstanding, this industry has every right to question the relationship. Maybe HISA calls that independence. I call it a structure that should never have existed. Then came enforcement. Suspensions. Enormous legal expenses. Lost purse money. Damaged reputations. Careers and livelihoods hanging in the balance. In my opinion, HISA’s penalty and adjudication system has deprived too many people of the practical due process Americans should expect before their livelihoods are turned upside down. Then there’s testing. Labs have been removed from the system. Results have mostly taken far too long. Yet this is the organization demanding absolute compliance from everyone else. And who pays for all of this? WE DO. Owners. Trainers. Racetracks. Horseplayers. The industry. Tens of millions every year for another layer of bureaucracy while racing struggles with declining foal crops, shrinking fields, wagering problems, track closures and an ownership base desperately needing growth. HISA was sold as the solution to racing’s credibility problem. Instead, HISA has developed a credibility problem of its own. A regulator shouldn’t demand transparency without providing it, demand accountability while avoiding accountability for its own failures, or demand timely compliance while its own testing system suffers delays. And it should NEVER wield enormous power over people’s livelihoods without unquestionable fairness and due process. Marshall Gramm isn’t the HISA story. He’s one chapter. The real story is how our industry surrendered enormous regulatory authority to an organization inadequately funded at birth, financed partly through industry loans, plagued by testing controversies, enormously expensive and given extraordinary power over the people who actually own, train, breed and race the horses. STOP PATCHING HISA. THE EXPERIMENT HAS FAILED. AND SHAME ON YOU @jockeyclub . Congress needs to investigate what it created, the money, loans, testing, technology, enforcement, conflicts and governance. Then ask: If HISA disappeared tomorrow, could we build something better, fairer and dramatically less expensive? We’ve learned a lot, I believe the answer is YES. Horse racing needs national coordination, integrity, uniformity and strong testing, not an unaccountable regulatory empire costing this industry tens of millions every year. REPEAL HISA. You asked for my thoughts. Sadly, I have a lot of them on the topic. But for me the most impactful one is around leadership in general. When I was a young man, I was blessed to go to dinner with General Norman Schwarzkopf. During that dinner we got to talk about his "Rule 14" of leadership. It was the rule that a leader should always "Do what is right." And that when things are difficult, a leader always knows what is morally and ethically the correct thing to do. Even if it is difficult, you do the right thing. Marshall Gramm's utilization of private HISA data can be argued legally and it can be viewed from the always checkered world of data utilization in American racing. But what bothers me the most is that Marshall was a "leader" in the industry. He was invited to the most important circles and he was granted the responsibility to represent the entire game once he was at the table. With that responsibility, when he identified an obvious and clear technical data management failing by HISA's Portal, instead of "doing the right thing" and instantly tell the powers that be at HISA about it, he decided to utilize the data. Someone would say that he actually exploited it. He decided not to lead at all. He decided to find his angle and profit off of it. I do not know Marshall. I have met him at racing events and had brief conversations. But his actions just make me sad. Anytime a leader fails at Rule 14, we all must pay the price. Sadly, I think Marshall all let us down.

The entire point of HISA is to protect the integrity of racing and create a level playing field! If confidential vet records were accessible to someone who could wager, claim and own horses, that mission has failed. This deserves a serious investigation and some serious answers.🤬🤯

I love racing at Hoosier and I have always done very well there… but looking at the big picture this is a terrible day for harness racing and a terrible day for my family farm in NJ which inevitably will be sold and turned into another Amazon warehouse. I think Hoosier will do well with the race the negative impact of the racing moving is far bigger

Todd Schrupp says the quiet part out loud. There was no inquiry posted by the Saratoga stewards and there absolutely should have been, regardless of how one may feel of what the outcome should be. An inquiry is a REVIEW. The New York stewards stand is an incompetent bunch.
