@PJSobkowski Though the Scalia view itself was once quite heterodox, so maybe the issue is more complicated. My reading of Morrison v. Olson is that the 7 justices in the majority thought that they were restating the consensus on separation of powers.
Liberalism as a Way of Life is off to the printer! Look for it in early June to learn how you're liberal deep down. @PrincetonUPress

That's very gratifying to hear, thanks.
This discussion between @IChotiner and my colleague, @RickPildes, is the best summary I've read of the issues surrounding removing Trump from the ballot under the 14th Amendment. Highly recommend. newyorker.com/news/q-and-a/c…

There are familiar criticisms of her work for being more ad hoc and not drawing sharp doctrinal lines. And of course I disagreed with some outcomes. But she did what she thought was right and did not care about criticism, including from within her own camp.
Justice O'Connor embodied judicial courage, as I define it. It's not casting votes you believe right that are "unpopular;" it's doing that when they are unpopular within the reference groups you rely on for validation. Wrote a short post in 2019 on this: bit.ly/47uvftD

We have lost a true icon: a strong, fearless woman who blazed a trail for so many women in politics. I disagreed with some of her positions, but I have nothing but admiration for her courage and tenacity. Rest in peace, Dianne Feinstein.
Happy 99th birthday, President Carter! You’ve inspired so many people around the world with your leadership, character, and commitment to service. Michelle and I hope you have a wonderful birthday and send our best wishes to you and Rosalynn.
This is the most innovative VRA suit I've seen in some time.
@ElectionClinic just filed this brief in our VRA lawsuit challenging the timing of Colorado Springs's municipal elections. COS's April off-year elections cause a huge racial disparity in turnout -- ~15% for minority voters versus >30% for white voters. static1.squarespace.com/static/60a559b…
