Someone was complaining to me recently about a bad moot they experienced. I've never really thought about that issue before. If your mooters are unprepared, or don't get it, how can you still make that moot productive? #AppellateTwitter.
Too often, the perspectives of those most deeply impacted by decisions from appellate courts go unheard, but we aim to change that. Join our mission to empower the next generation of attorneys and judges in our highest courts: theappellateproject.org/donate #appellatetwitter
@KareBearScare @danepps @smmarotta Yeah, maybe not the best word choice. Mostly lawyers. Some probably draft briefs. Probably nearly none draft briefs for SCOTUS. I meant to suggest that @smmarotta got himself in trouble when his tweet leaked outside #appellatetwitter.
On May 17th, I will be speaking at the Collin County Bench Bar (at the newly-opened @RClascolinas). Then on June 20th, I will be speaking at the @statebaroftexas annual meeting (at the @HiltonAnatole). #appellatetwitter
@LoProCo @smmarotta Yeah I would say it depends but generally I probably would not worry as much about the writing nitpicks so much as how the brief actually looks. I’m sure there is something there familiarity-wise but not substantively, I don’t think. At least mostly. #AppellateTwitter
Apparently there’s been drama in #appellatetwitter today. But the real tea is the number of typo-haters making an appearance in #appellatetwiter over the years 👀 #BigLawStrong #lawreview
Just discovered that a case I prepped for my judge while sitting by designation on the 11th Circuit was granted cert. I suppose some of the circuit clerks on #AppellateTwitter are used to the feeling, but it’s still insanely cool for a district clerk.
I did like 20 slides on appellate standards of review, I think this is like the #AppellateTwitter analog to an operatic mad scene.
If you aspire to be an appellate attorney, don't let anyone tell you that you have to be in biglaw. I've never been in biglaw, and four-and-a-half years in have managed to develop a consistent SCOTUS-level practice. #appellatetwitter
Maybe it was Francis Bacon who wrote that BIO. #appellatetwitter
Working on a CLE about appellate standards of review in MA criminal cases, and I think I might have just slipped into madness making this chart that tries to map them all out. #AppellateTwitter
@CecereCarl do you think that one was too subtle or did it hit the sweet spot for today's top #appellatetwitter controversy
@smmarotta Does anyone think the Justices believe an arrogant, self-important member of #biglaw/#appellatetwitter wrote this tweet? Narrator: Yes, yes, they do. They also think “jargon” would have been a better word choice than the awkward “specialist-isms.”

@BrandonMagner @smmarotta A classic example of the bizarre #AppellateTwitter belief that the only thing that matters in life is getting to appear in front of the Supreme Court. Outcome doesn't matter. The principle that you're arguing for is irrelevant. Just get those reps, baby.
Ways you can tell a solo lawyer wrote the appellate brief: - Pages smell like cigarette smoke - Uses “comprises” incorrectly - commas in introductory signals italicized (or is it not italicized?) - “That dog won’t hunt.” - Two words: Ketchup stains. #AppellateTwitter
@jfleming2870 @smmarotta I love how that case was canonized at the time as a “battle of the titans” by #AppellateTwitter when in reality it was Sean arguing an insane view of the law that got smacked down by judges of all stripes. I imagine it was good for the billables, though.
Watching the #appellatetwitter drama like
#appellatetwitter Stuff like this is why I end up having to handle what amount to interviews from out of state attorneys who clearly don't believe I wrote something I wrote. For the record, it's pretty insulting.
