We’re thinking about selling our house. But instead of making the buyer get a mortgage, we might finance the purchase ourselves at 6.25%. The buyer gets a chance at a lower rate. Last week I gave a presentation about the importance of vetting an HOA before writing offers on a condo. It put some folks to sleep, yet I got a call from their office today to let me know their buyer is cancelling a non-contingent offer with their deposit at risk bc the lender realized the condo was non-warrantable. If you're buying a condo, I don't care what anyone says, add a 7-10 day HOA contingency. 99% of listings are not prepared with the proper information a lender needs to sign off on the HOA. You cannot finance a condo with standard market rates without a warrantable determination in underwriting. This can be done upfront, before a listing goes live. Fun (really!) fact about California. All beaches up to the mean high tide line are state land and are available for public use. Beachfront homes are prime real estate and often have multi million dollar price tags. Owners of these properties know, or should know the legal status of property in such locations. As sea level rises, as storms worsen, the Pacific Ocean is pushing inland, right under these houses. What was once private land becomes state land and courts have ruled over and over that properties built after 1977 when the law was enacted cannot expect any restitution or even build permanent sea defenses because that will harm the beaches that belong to the people of California. Properties were built on eroding shorelines and developers knew it and built anyway. Buyers knew (or should have known) what the law was but bought anyway either assuming the geologic and climatic forces were occurring too slowly to matter and in the worst case scenario the taxpayers would bail them out.
