I have no doubt whatsoever, that you will improve on the foundation laid down by Mr Justice Daniel Musinga in particular, actualizing the hearing of applications within 60 days of filing, and hearing of appeals within 12 months of filing.

And finally, the determination by the court just shows how poorly the court conceptualised the issues at hand. It was a determination that Justice Norbury Dugdale (KANU's favourite judge) would be very proud of and treasure. The reasoning borrows heavily both in style and in form from the KANU enforced judgments of the High Court of late 1980s and early 90s. First, the court deliberately creates two false equivalents of what the conservatory order intended to address. The court in the process created two inevitable scenarios. It made the removal of Gachagua inevitable. It also made and the swearing of Kindiki inevitable. But it is DUGDALIAN reasoning of the court that is breathtakingly superficial as it is was TRANSPARENTLY dishonest. Instead of addressing why the conservatory order should be discharged or retained, the court went on a tangent that was legally just untenable as it was dishonest. It wasted so much time writing about the offices of Deputy President under 2010 constitution and vice president under the repealed constitution (as if that was relevant or contested). Then it addressed the importance of the office under the 2010 constitutional architecture (banal analysis...for that was not an issue before the court). Ultimately, the court discharged the conservatory order on the basis that the Office of Deputy President can't remain vacant and is too important to be the subject of the type of litigation before the Court and that the swearing in of Kindiki was very important for Kenya...🤣🤣🤣 (i thought the conservatory order stayed Gachagua's impeachment and removal and dejure made him the lawful deputy president of Kenya). In a week, when the Supreme Court ruled that Article 10 of the constitution is dead as a dodo and parliament's actions cannot be questioned in court, Kenyans sadly realised that we are back in the KANU days and just like those dark days, the executive and not WE THE PEOPLE, are the true owners of the Kenyan judiciary. SAD...VERY SAD!

The court got it wrong on the ratio decidendi of Marbury v Madison. This case established the place of judicial review, which is the power to declare law unconstitutional...that nothing in terms of government's action or omission is beyond the scope of the court's adjudicatory powers. Can't understand why the court seeks to dilute the revolutionary judgment in Marbury v Madison with the dicta "...certain political questions are outside the scope of judicial review"

Justice Daniel Ogembo Ogola, judge of the High Court of Kenya The philosopher Socrates once said, "Four things belong to a judge: to hear courteously, to answer wisely, to consider soberly, and to decide impartially." Justice Daniel Ogembo Ogola epitomized these virtues, embodying the very essence of a model judge. His demeanor was calm and humble, and his respect for others profound. He was not only a keen listener but also an astute thinker whose jurisprudential contributions will continue to enrich our legal landscape especially in the area of criminal law where he delivered numerous path charting decisions while serving as a Judge at Eldoret Law Court, the Milimani Criminal Division and as the Presiding Judge at Siaya High Court at the time of his untimely passing. Justice Ogembo's journey in the Judiciary began in 2004 when he joined as a Senior Resident Magistrate. Through sheer hard work and dedication, he quickly rose through the ranks, becoming a Chief Magistrate and eventually a Judge of the High Court in 2016. His ascent was a testament to his commitment and passion for justice. During my visit to Siaya in June 2023 to launch the Siaya Law Court, I witnessed firsthand his exceptional ability to work collaboratively with stakeholders. He brought together stakeholders in the justice sector, fostering coordination and collaboration to ensure the seamless delivery of justice. His dedication to this cause was evident in every interaction. Another thing that struck me during my visit to Siaya was Justice Ogembo's unwavering commitment to ensuring access to justice for the vulnerable. His dedication to survivors of gender-based violence led to the establishment of a Special Gender-Based Violence Court at the Siaya Law Court. Furthermore, under his leadership, Siaya developed one of the most vibrant Children's Court Users’ Committees in the country, prioritizing children's issues and concerns within the justice system. His compassion knew no bounds. We extend our deepest condolences to his family, friends, and colleagues within the Judiciary. The loss of Justice Ogembo is felt profoundly by all who knew him and by those who benefited from his wisdom and compassion. May his soul rest in eternal peace. Hon. Justice Martha K.
