@bnhowe @BillMatarazzo @AlanZibel @DA_Osorio @aintthatZo @brianrkramer Brigid, courts admit statements all the time from non-parties. They are witnesses, and they either sign affidavits under oath, are deposed, or testify at trial, etc. What led you to believe "that sounds an awful lot like hearsay"?

@AlanZibel @BillMatarazzo @DA_Osorio @aintthatZo @brianrkramer Alan, this is what they say now, in an advocacy brief, but Superintendent Smith specifically said in April 2018 that adding the wording could inadvertently tie the hands of the Board from having flexibility.

@AlanZibel @BillMatarazzo @DA_Osorio @aintthatZo @brianrkramer If they did get an adverse decision, they could absolutely redo FAA, (and a public notice period + more than 11 days might help their cause). If process—> followed, the decision is the decision and we all live with the decision. Not so hard.

@AlanZibel @BillMatarazzo @DA_Osorio @aintthatZo @brianrkramer Alan, in-house legal counsel are human, too, and make mistakes or can’t prevent a mistake because it already happened. That’s why there are many, many, many decisions (blessed by in-house attorneys) that are later overturned. Your unlimited $ is stronger.
